1. Contract Description 

This contract is a legal document stating your rights and obligations and those of thefineartcompany.co.uk limited t/a The Fine Art Company, (hereafter referred to as The Fine Art Company). These terms and conditions apply every time you, access our site, use our services or make a purchase. Please take a few minutes to read through them.

2. Entering into a Contract with us

To enter into a contract with us you must be over the age of 18. You must also complete the purchase by submitting your correct name, address and other details. If you use a credit or debit card you must be fully entitled to use that card at the time when you provide details to us, also there must be sufficient funds available to your card at the time of the transaction to cover the full cost of your purchase. If, for any reason, you make a mistake when entering your details, please contact us with the correct information as soon as you are aware of the error.

3. Credit/Debit Card Charging Procedure

When you make a purchase by Credit or Debit card for unframed prints your card will be processed shortly after we receive your order, prints are usually dispatched within 5 working days although we cannot always guarantee this. Custom framed prints are usually dispatched within 12 days.

We process all Credit or Debit card payments by hand, so your card is not automatically processed the minute you click on the button, if you have made a mistake email us within 24 hours and we will cancel the transaction, make a refund, or correction, as necessary.

4. Value Added Tax (VAT) and Non EEC Taxes for US and Canadian Customers

You will be charged Value Added Tax (VAT) at the standard UK rate if your purchase is made within the United Kingdom. After completing your purchase you will  receive an e-mail order acknowledgement showing the tax paid and a VAT invoice will follow by post. 

If you are in the USA or Canada you will not have to pay VAT, but it is important to note that the currency you are buying in is UK Pounds. Most of our shipping is done by our US based agents but on certain occasions an extra shipping charge will apply, if this is the case  we will contact you about this before we process your order. Please note that you may also have to pay other taxes or duties payable in your Country for which you are solely responsible. Not all prints are available in the USA and Canada, if this is the case we will let you know.

5. Sizes, Product Descriptions and Colour Matching

The sizes of fine art prints, posters and serigraphs shown on the website relate to the overall paper size it should be understood that the image size may be smaller due to borders. Frame sizes relate to the glass size, which means that the overall size of a frame is often a little larger than stated. All size descriptions shown are subject to a tolerance of plus or minus 5%. 

We describe each fine art print as accurately as we can but occasionally errors occur for which we apologise. If you notice an error on the website please point it out to us. 

Individual monitor settings and photography combined, mean that the colours you see on the screen are almost certain to vary to some extent from the true colour of the product, this is a limitation of technology. If the mount (mat) colour you choose is critical in a framed print please ask us to send you a sample before ordering.

6. Copyright

All images, code, text, logos and trademarks contained in this website are subject to copyright by The Fine Art Company or their respective owners. All rights are reserved. You must not use, copy, modify or distribute these images or any part of an image, digitally or by any other means without the express permission of the copyright owner.

7. Use of our Website

If you abuse our fine art print website The Fine Art Company reserves the right to cancel any transaction, particularly where we have reason to suspect that the code of our website has been tampered with to make a fraudulent transaction. Any such abuse or attempted fraud may be reported to the relevant authorities and may lead to further action.

The Fine Art Company website does not knowingly link to obscene, pornographic or illegal sites, and the website links placed on these pages have been done so in good faith. Links are checked on a regular basis, but because the Internet is a rapidly changing environment links may change between checks. Please let us know if you feel something is inappropriate or has been missed.

8. Exclusions and limitations

Except for death or personal injury caused by our negligent acts or omissions we shall only be liable for any loss or damage which is a reasonably foreseeable consequence or breach of this agreement. In the event that you are using The Fine Art Company's services in part for commercial purposes then no liability for loss of profits or other economic loss arising out of a breach of this agreement can be accepted.

9. Changes to these Terms and Conditions

The Fine Art Company reserves the right to change the terms of this agreement at any time by, posting a revised page on our art website. The terms of our contract with you will be based upon those terms and conditions current at the time you placed your order.  

10. Applicable Law

The Fine Art Company is a company registered in England. These terms and conditions are governed by the laws of England. All disputes arising out of your access to this website or any transactions resulting from such use, including (without limitation) all contractual and other relationships are subject to the exclusive jurisdiction of the English courts.
